Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms", "Agreement") constitute a binding legal contract between you ("User", "you") and Curiosity Teknoloji A.Ş. ("Curiosity", "ZekAI", "we", "our", or "us"), governing your use of the ZekAI platform, including its website, mobile apps, APIs, and related AI services (collectively, the "Services").

By accessing or using ZekAI in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein.

If you do not agree, you must immediately discontinue all access and use of the Services.

We reserve the right to modify, amend, or replace these Terms at any time, effective upon posting on our official channels. Continued use of the Services after updates constitutes your acceptance of the revised Terms.

2. Scope of Services

ZekAI provides advanced AI-driven technologies, including but not limited to:

• AI text, chat, and conversational assistants;
• AI image and video generation;
• Face swap, style transfer, and generative deep-learning models;
• Voice synthesis and data-to-media processing tools.

We make no guarantee that the Services will be available continuously, error-free, or compatible with all systems, regions, or laws.

We may modify, suspend, restrict, or terminate any part of the Services at any time, without prior notice and without liability.

3. Eligibility and Account Responsibility

1. You must be at least 18 years of age or the age of legal majority in your jurisdiction.
2. You must provide accurate, complete, and up-to-date registration information.
3. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. Curiosity reserves the right to suspend, terminate, or restrict access to any user or account, at its sole discretion, for any reason, including violation of these Terms, suspected fraud, or legal non-compliance.
5. ZekAI retains full ownership of all account infrastructure. Users receive only a limited, revocable license to access and use the platform.

4. User Content and AI-Generated Material

(a) Inputs and Outputs

When using the Services, you may submit content ("Inputs") and receive AI-generated results ("Outputs").

• You retain ownership of lawful Inputs you submit.
• To the extent permitted by law, you own the Outputs generated from your Inputs.

However:

• Curiosity and ZekAI retain ownership of all intellectual property in their models, algorithms, datasets, and processing pipelines.
• Generated content may include elements derived from or influenced by data used to train the AI model; such elements remain the property of Curiosity or its licensors.

You hereby grant ZekAI a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, analyze, and distribute your Inputs and Outputs for:

• Improving AI performance and safety;
• Research and development;
• Legal compliance, auditing, and system integrity purposes.

5. Prohibited Uses

You shall not use the Services to:

1. Violate any law, regulation, or third-party right (including copyright, privacy, publicity, or trademark rights).
2. Generate, promote, or disseminate:
   • Hate speech, discrimination, or harassment;
   • Pornographic or sexually explicit material involving real persons without consent;
   • Deepfake or manipulated media used for defamation, fraud, or misinformation;
   • Terrorism, self-harm, or violence;
   • Content designed to influence elections or political campaigns.
3. Upload or transmit malicious code, malware, or attempt unauthorized access to the platform.
4. Use ZekAI outputs to train or develop competing models, or extract source data.
5. Resell, sublicense, or redistribute Services or generated content without written permission.
6. Interfere with or disrupt the integrity or performance of the platform.

Violation of this section may result in immediate account termination, permanent access bans, and potential legal action.

6. Intellectual Property Rights

All intellectual property rights in ZekAI's Services—including but not limited to software, interfaces, designs, algorithms, model weights, training data, and trademarks—are owned by Curiosity Teknoloji A.Ş. or its affiliates and licensors.

Users acquire no rights, title, or interest in or to the Services other than the limited license expressly granted under these Terms.

You may not reproduce, reverse-engineer, disassemble, or modify any part of the Services, nor create derivative works without prior written authorization.

7. Data Protection and Privacy

We process your data in accordance with our Privacy Policy, compliant with the Turkish KVKK, EU GDPR, and other applicable data laws.

By using ZekAI, you consent to the collection, use, and storage of data, including:

• Uploaded content, prompts, and generated outputs;
• Usage statistics, device information, and connection metadata;
• Optional feedback for model improvement.

ZekAI applies reasonable administrative, physical, and technical safeguards, but no system is fully secure. You acknowledge and agree that data transmission via the internet is inherently insecure and may be intercepted.

You bear sole responsibility for any data you upload or distribute through the platform.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND.
• CURIOSITY AND ITS AFFILIATES EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.
• WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR FREE FROM ERRORS OR HARMFUL COMPONENTS.
• YOU USE THE SERVICES AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• IN NO EVENT SHALL CURIOSITY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
• THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• CURIOSITY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO CURIOSITY IN THE PRECEDING SIX (6) MONTHS OR USD 100, WHICHEVER IS LOWER.
• CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY — IN SUCH CASES, OUR LIABILITY SHALL BE LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless Curiosity, its subsidiaries, officers, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including attorneys' fees) arising from:

• Your use of the Services or generated content;
• Violation of these Terms or applicable law;
• Infringement or misuse of any third-party rights.

This obligation shall survive termination of your account and use of the Services.

11. Termination

We reserve the right to terminate or suspend your access to the Services at any time, without notice or liability, for any reason including but not limited to:

• Breach of these Terms;
• Legal or regulatory requirements;
• Security or operational concerns.

Upon termination, all rights granted to you under these Terms shall immediately cease.

You remain responsible for any obligations incurred prior to termination.

12. Force Majeure

Curiosity shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet outages, governmental actions, or technical failures.

13. International Use and Compliance

You agree to comply with all local laws in your jurisdiction regarding online conduct, content, and data export.

If you access ZekAI from outside Türkiye, you are solely responsible for compliance with local regulations.

Curiosity makes no representation that the Services are appropriate or available for use in all territories.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict of laws principles.

All disputes shall first be attempted to be resolved amicably.

If unresolved, disputes shall be referred to and finally settled by arbitration before the Istanbul Arbitration Centre (ISTAC), in English or Turkish, under ISTAC rules.

The arbitral decision shall be final and binding, and may be enforced in any court of competent jurisdiction.

15. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure to enforce any provision shall not constitute a waiver of that provision or any other provision.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Curiosity regarding the Services, superseding all prior communications or agreements.

No modification shall be binding unless made in writing and signed by authorized representatives of Curiosity.
